Privacy Notice

Preliminary remarks

NextGen Capital SA, located at Rue De-Candolle 24, 1205 Geneva (the “Company”), has prepared this Privacy Notice in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the General Data Protection Regulation (GDPR). This Privacy Notice is intended to inform users of the Company's website about how their personal data is collected, used and otherwise processed, as well as about their rights in relation to such processing.

2. Categories of personal data processed

We may collect the following personal data: the information you provide through our contact form, including your name, email address, phone number, area of interest, and message; login credentials and session identifiers for clients accessing the Fund area; server access logs, including the timestamp, IP address, and user agent, which are retained only for a limited period; and information disclosed to our anti-spam provider when you use the contact page (see Section 5).

Providing the contact-form information is entirely voluntary. It is neither a statutory nor a contractual requirement. If you choose not to provide this information, we will simply be unable to respond to your enquiry.

The cookies and browser-storage entries used by this website, together with the information stored by each of them, are listed in our Cookie Policy. We do not use analytics, advertising, or tracking technologies.

3. Purposes and legal bases

Personal data submitted through the Contact Form is collected and processed solely for the purpose of handling and responding to users' enquiries and will not be further processed in a manner incompatible with this purpose. Such processing is carried out in accordance with Articles 6 and 7 FADP and, where applicable, Articles 5 and 6 GDPR.

4. Recipients

The Company is the sole recipient of personal data submitted through the Contact Form. However, such data may also be accessible to the Company's hosting service provider to the extent necessary for the provision of its services.

5. Cross-border transfers

Our website and email are hosted in Switzerland; this data does not leave Switzerland.

The anti-spam verification on our contact page is provided by Cloudflare, Inc., United States, which receives limited technical data, including your IP address, when you use that page. This transfer is safeguarded by Cloudflare's certification under the Swiss–US Data Privacy Framework. Apart from the above, we do not transfer personal data abroad.

6. Retention periods

The Company retains personal data for as long as necessary to fulfil the purposes for which it was collected and to comply with contractual and legal requirements. Once personal data is no longer required for the purposes for which it is processed and no legal or regulatory obligation requires its continued retention, the Company will delete the information in accordance with applicable law.

7. Client rights regarding personal data protection

Subject to applicable data protection law, individuals may have the right to access, rectify or delete their personal data, object to or restrict its processing, withdraw consent without affecting prior lawful processing, and exercise any other applicable rights available to them under applicable law.

The Company may refuse, restrict or delay access where permitted by law, including to protect confidentiality, third-party rights or its legitimate interests, or where a request is clearly unfounded or abusive.

Requests should be submitted using the contact details in Section 1. The Company may require proof of identity.

You may also lodge a complaint with the FDPIC (edoeb.admin.ch) or your local EU supervisory authority.

8. Automated decision-making

The Company does not carry out automated individual decision-making or profiling within the meaning of Article 21 FADP. The anti-spam verification described in Section 5 is an automated check of whether a submission is made by a human; it produces no legal effect concerning you and no comparably significant effect.
